Directed Verdict + $800,000+ – Landlord v. Tenant Dispute

Plaintiff and Counter-Defendant Hill Country Partners own a 200,000 +/-sq ft shopping center in Castle Hills, Texas. Baribeau signed a 5year lease for a 20,000sq ft space to open and operate a gym. Approximately 12 months into the lease Baribeau was unable to pay the entire rent and began making partial payments. Hill Country continued to work with for months until Baribeau until she was evicted for non-payment.

Hill Country sued to enforce the personal guarantee after not being able to lease the space.

Baribeau countersued claiming fraud for alleged tampering with the original lease. The judge granted a directed verdict after a 2 week jury trial in the favor of Hill Country and $800,000+ in attorney’s fees and compensation.
